A lawsuit was filed last week in Circuit Court against West Virginia Polymer, a Millwood manufacturing company, claiming that the company has failed to pay lease payments for several months and seeking to bar the company from selling any assets until payments are received.
The suit was filed last Tuesday by Orlandi, Inc., a West Virginia company which owns the lease to the commercial property housing WV Polymer.
According to the complaint, Orlandi accuses WV Polymer of failing to make any lease payments since September 2009. The complaint seeks damages of $152,218.43 for past due lease payments, $7,013.02 for late fees, and $24,686.14 for ad valorem real estate taxes, plus additional amounts for attorney’s fees and court costs, interest, and other additional relief the court may deem proper.
QXL Industries, Inc., a Deleware corporations that served as Guaranty company in the lease agreement, was also named as a co-defendant.
Also in the suit, Orlandi claims that WV Polymer is currently in the process of liquidating and selling equipment to an undisclosed third party, so they have included in the suit a motion for injunction asking the court to enjoin and prohibit WV Polymer from liquidating or selling any equipment or personal property without court approval.
Orlandi is seeking a hearing this week on their injuction motion. WV Polymer has 30 days to respond to the suit.
The case has been assigned to Judge David W. Nibert for hearing.
A call to WV Polymer ownership seeking comment went unanswered as of press time.
